46. Symbols and inscriptions of privately-erected signs
(1) Where the Minister, local authority or other authorised entity in terms of section 39 of the Act has authorised another person to erect a sign on or near any road:
(a) the person may with the approval of the Minister, Local authority or other authorised entity display its badge on such sign;
(b) the owner of such sign shall maintain it in such conditions as to render it visible and effective at all times.
47. Prohibition on advertising material on or attached to road traffic sign or used in advertisement
(1) No person shall display or allow to display any advertising material or attach it to a road traffic sign.
(2) No person shall use or portray a road traffic sign in an advertisement, where such advertisement is visible to a road user while travelling on a public road.
48. Transitional provision
(1) A road traffic sign which could, prior to the commencement of this Part, validly be displayed in terms of the Act, may, notwithstanding the provisions of this Part be displayed on a public road until 31st December, 2025.
(2) A road traffic sign contemplated in subsection (1) has the same meaning assigned to a corresponding road traffic sign in the First Schedule:
Provided that a stop sign R1 which could have been displayed prior to the commencement of this Part shall, when it is displayed as a 3-way or 4-way stop sign, have the same significance as stop signs R1.3 and R1.4 respectively as in the First Schedule.
49. Offences and penalties
(1) Any person who:
(a) removes, damages, obscures or interferes with any sign or the support thereof; or
(b) attaches any notice or thing to any sign or to the support thereof;
shall be guilty of an offence.
(2) Any person guilty of an offence under these regulations shall be liable to a fine not exceeding level five or to imprisonment not exceeding six months or to both such fine and imprisonment.
50. Exemptions
(1) The Minister may grant an exemption from any of the provisions of these regulations subject to such conditions as he or she may impose.
(2) Any exemption granted in terms of subsection (1) shall be in writing.
(3) A certificate purporting to be signed by or on behalf of the Minister and setting out the conditions subject to which any exemption has been granted in terms of this section should be "prima facie proof, on its mere production, of the facts stated therein".
51. Repeals and savings
(1) The Road Traffic (Traffic Signs) Regulations, 1973, published in Statutory Instrument 573 of 1973, are repealed.
(2) Despite subsection (1), the repealed regulations shall continue in force in relation to any traffic sign prescribed by the repealed regulations that is not on the date of publication of these regulations replaced by a traffic sign prescribed by these regulations.
(3) Notwithstanding the provisions of section 50 (Exemptions), any person convicted of an offence under or in connection with regulations repealed by these regulations shall be deemed for the purposes of subsection (2) to have been convicted of an offence under the equivalent section of these regulations.
